现代法学方法论的研究对象和范围

The Object and Scope of the Methodology of Jurisprudence Research

法学方法论是法理学研究的重要内容之一,也是与法律实务最密切相关的部分。但是,中国法学界对其研究的对象和范围没有清楚的认识和界定。应当说,法学方法论的研究对象和范围包括法的渊源、案件事实的认定、法律解释、法律漏洞的填补、法的体系等。

The methodology of jurisprudence is not only an important content of jurisprudence research but also is intimately related to legal practice. Unfortunately, it seems that Chinese jurists have no clear understanding or made no clear delineation of legal methodology. This author maintains that the methodology of jurisprudence includes： the source of law, the identification of legal facts, interpretation of law, filling in gaps in the law, the legal system, etc.
