Ownership of Garages in the Real Right Act and Its Relevant Problems

车库的归属是建筑物区分所有中的一项具体制度,该制度的设计不仅关系到广大城市居民的权益保护,也关系到整个小区的和谐。在现有的各种解决方案之中,《物权法(草案)》的设计虽然仍存在着缺陷,但相比较而言,是更合理的制度设计,因而应当在物权法中继续予以坚持。

Ownership of garages is specifically provided in the division of buildings, the plan of which is not only related to the protection of the rights and interests of broad urban residents, but also to the harmonious life of the whole community. Compared to all other resolutions, the provision in the Draft of the Real Right Act, imperfect as it is, is deemed the most reasonable one and thus should be maintained in the future Real Right Act.
