环境的刑法保护

Penal Protection to Environment

刑罚对保护环境及环境法的实施有重大意义。中国刑法在保护环境上存在软弱性。应从增设环境犯罪的新罪名、确立环境犯罪的犯罪构成、在刑法典中设立危害环境罪章节等方面,进一步加强刑法对环境的保护。

Penalty took great effect to environmental protection and implementation of environmental law. Chinese criminal law was weak in environmental protection. Adding new charge of environmental criminality, defining the environmental criminality constitution and establishing chapters and section of environmental criminality in Penal Code could strengthen penal protection to environment.
