我国农地产权制度的公平与效率性分析

Analysis on Fairness and Efficiency of Agricultural Land Property System

从经济学的角度对现阶段我国农地产权制度的公平性与效率性进行研究。分析指出:现有的农地产权制度坚持集体所有制为基础,农地承包经营权的配置与农地产权的初步流转制度体现了公平与效率,但是还很不足,表现在土地征用制度对农民土地权益的侵害,集体内部农民集体土地所有权缺乏制度保障,土地承包经营权不完整、配置不合理,农地产权流转制度不完善等方面,体现了制度的不公平性与低效率。

This paper studies the fairness and efficiency of the present stage of our agricultural land property right system from an economics view. It points out that the existing system of agricultural property right is based on the collective ownership, and the allocation of agricultural land operating rights and the initial transfer of agricultural land ownership embody fairness and efficiency. However, it is far from perfect, such as the land acquisition system against farmers＇land right; the lack of security system within the collective land ownership; the imperfect franchise distribution; incomplete rights and imperfect transfer system. All of these suggest the unfairness and inefficiency of the present system.
