The Research on Existent Issues and Measures of Actual Confiscating System

本文首先讨论了现行征地制度存在的问题,即补偿标准不合理、征地补偿费用分配中截留现象严重、农村集体土地所有权主体虚位等;然后,提出了解决办法,即不管是征收还是征用都要提高征地补偿标准,并按照土地新用途的市场价格进行补偿,在征地补偿费用分配中,要合理协调国家、集体、农民三者之间的利益;最后,对今后的征地工作提出了一点设想,即在非公益类用地中,要让企业或用地单位与农民集体直接谈判,商讨土地价格,而政府则只作为一个中介机构完全退出,在公益类用地中,政府可以委托中介机构进行监督,与农民进行谈判。

First, this essay discusses the existent problems of actual system about confiscating land： the compensatory criteria are not reasonable; the expenses are usually cut down from peasants during the period of their allotting; the main body about the ownership of country collective land is uncertain. Then, it presents measures accordingly： increasing the compensatory expenses whether levying upon or confiscating land, compensating expenses to peasants according to the marketable price of new land-use; harmonizing the benefit of nation, collectivity and peasants during the period of allotting expenses. Lastly, this essay puts forward a piece of advice about the work of confiscating lahd： to commonweal land, let corporation or land-use units negotiate and bargain with peasants at first hand, the government quit completely as an agency; to non-commonweal land, the government can negotiate with peasants while consigning agency to supervise.
