《一个馒头引发的血案》等网络演绎作品的出现,引发法学界关于著作权的争论。众所周知,电影的著作权属于制片人。由于电影是一种合成作品,声音与动态图像是其最基本构成要素,单纯从声音或动态图像就能判断出是此电影,因此,基于声音或动态图像而产生的视频音频短剧应当属于电影演绎作品。所以说,该类短剧的作者在行使其著作权时应当遵守我国《著作权法》的有关规定。否则,就会侵犯电影制片人的权益。

The appearance of deductive film-works like ＂The Murder Case By a Steam Bread＂ has triggered contentions over copyright in the law sphere. It is well known that the film＇s copyright belongs to its producer. Film is a synthesized work which is basically composed of audio and active pictures. We can judge the film＇s name from only audio or video. So, the video and audio short films produced on audio or video should be the de- ductive film-works. The authors of this kind of short-films should abide by the Copyright Law in our country, otherwise they will tort the rights and interests of the film＇s producers.
