论警察权力的限制与规范

On the clipping and regulating the power of police

警察具有国家统治工具和社会服务的双重角色和职能,由于保障国家统治和社会安全的需要,公安机关拥有一系列直接剥夺公民人身自由的权力。单纯地限制这种权力往往会极大地削弱公安机关打击犯罪的能力,甚至连警察自己的安全也不能保障。规范警察权力才是出路。对公民来说,凡是法律没有禁止的都是合法的;对警察来说,凡是法律没有授权的都是禁止的。

Police has two social players ： the tool of state Mling and society service. For the need of insuring state ruling and social security, public security organ owns a series of power to deprive citizens＇ personal freedom directly. To limit the power of police simply will weaken the ability of strikig crimes of the public security organ, moreover couldn＇ t insure the security of police. Regulating the power of police is the good way.
