论商法中的维护交易安全原则

关于商法的基本原则,在我国有较大的争论。其中较有代表性的是二原则说、三原则说、四原则说和五原则说。虽然他们对商法包括哪些具体的基本原则意见不同,但是他们都把维护交易安全作为商法的基本原则之一。本文从维护交易安全原则的确立依据、要义和立法体现出发,说明了维护交易安全原则在商法基本原则体系中的基础地位。

There are big arguments about the commercial law basic principle in our country. The main points have two principles, three principles, four principles and five principles theory. Although they disagree on which concrete basic principles does the commercial law include, they all regard the maintenance transaction security as one of the basic principles in commercial law. Based on its establishment basis, essential meaning and the legislation manifestation, I explained the maintenance transaction security principle＇ s foundation status in the basic principle system in commercial law.
