摘要
本文主要结合《劳动合同法(草案)》的内容提出几个在实践中比较突出的问题,也是立法亟需解决和完善的问题,比如订立劳动合同主体的范围应否扩大,如何合理设置试用期的规定以应对实际生活中出现的规避现象,如何规范用人单位制定规章制度的权利等。针对这些现象和问题,文章提出,应将家庭保姆纳入劳动合同的主体范围;应规定严密的试用期管理规定;用人单位制定的规章制度应经过行政机关的批准等。
Combining with the contents of Labor Contract Law, the author puts forward some problems in practices, such as the problems of how to rationally set probation period to deal with the problem of evasion in practice, and how to standardize the employer's right to formulate the rules and regulations. These problems are also the outstanding problems in practice. Based on the experiences of the author and foreign countries, the author puts forward his own viewpoints and suggestions that will be benefit to the formulation of this law.
