邓正来先生的《中国法学向何处去》一文是能够提供对我们时代的总体性认识框架并揭示其问题的“标准文本”。但这样的一个文本,却无论是在其自身陷入的“类型复制”现象还是对读者思考路径的否定式限定,以及根据其推论出的“中国法律理想图景”的内在性质等诸多方面,都生动地展示了“反讽”概念的丰富内涵。但也正是批判本身的这种矛盾性境遇,却向我们开放出了共商中国法学发展与法制建设未来的动人景观,而这正是我们能够最终走出困局、确立“中国性”的曲线行程的关键步骤,“现代化范式”危机批判的意义由此得以发掘和放大。

This article regards＂Jurisprudence of China ＂. Where to go＂ written by Deng Zhenglai as a standard text which supplies us the general framework of our time and reveals its basic problem. But such a text also displays its ironic dimensions , which lie in ＂the duplication of type＂ and the way to define the reader＇s thinking, as well as the nature of ＂China＇s le- gal ambition prospect＂ deduced from it. But just the very situation of contradiction opens to us the vivid prospect which all of us could discourse the future landsczpe of China＇ s jurisprudence and legal system, which is the key step we can go out of the plight and find the nature of Chinese culture. Thus uncovers and magnifies the sense of the criticism of the modernized model.
