Chinese Legal Systems Serve as Lessons to Modern Legislation——Taking the Laws in Tang Dynasty for Example

当代立法不应只注重参酌西方的法律制度和理论,也应当研究、借鉴和吸收中国法律传统中的合理性因素。唐代立法中的一些合理性因素,如某些立法技术、血缘关系立法以及官员职务犯罪立法等方面的一些规定,至今看来仍具有一定的合理性和生命力,对当代立法具有重要的借鉴意义和参考价值。

In Legislating in modem times, great attention should be paid not only to introducing western legal systems and theories but also to studying and using the rational factors in Chinese legal tradition for reference. There are some rational factors in the laws in Tang Dynasty, including some stipulations on legislative technology, the legislation of genetic connection and officials＇job offence. And up to now, the rational factors have had certain rationality and vitality. We, therefore, should use them for reference.
