论巩固和完善我国贸易救济措施的基本原则

On the Basic Principles of Strengthening and Improving China's Trade Remedy

随着我国进口规模的迅速扩大,企业面对的公平竞争和不公平竞争也越来越激烈,建立时间还不长的我国贸易救济制度措施亟待进一步巩固和完善。为此,本文提出了适当援用,减轻损害;完善法律,有法可依;健全组织,明确责任;严格条件,避免滥用;防患未然,有效预警等五项巩固和完善的基本原则,并一一解释。

With China ＇s export and import volume increasing rapidly on a large scale, businesses are facing ever intense fair and unfair competitions. In this context, it is urgent to strengthen and improve China＇ s newly established trade remedy system. It is against this background that this article sets out to propose and expound the following five basic principles： use adequate precedents and reduce damage ; improve and follow relevant laws and regulations; build up organizations and clearly define rights and obligations; maintain strict criteria and prevent abuse; prioritize prevention and implement pre-warning.
