论我国政策性银行立法的完善——以实施“十一五”规划为契机

Perfecting the Legislation of Policy Banks While Implementing the Eleventh Five-year Plan

我国目前对政策性银行还没有制定专门法律,现行行政法规也鲜有对其作出规定,对政策性银行的规定多散见于一些决定、命令、规章等文件之中。立法层次低、体系混乱,制度构建存在缺失,立法明显滞后,制度设计粗糙、内容不够科学合理是当前政策性银行立法存在的主要问题。而“十一五”规划的实施为我们完善政策性银行立法提供了宝贵契机,体现在:通过立法进行改革是“十一五”规划有关政策性银行改革的基本精神,规划的整体实施将为立法提供实践平台和检验标准,“十一五”期间进行政策性银行立法的条件已基本成熟。因此,我们在“十一五”期间,应将政策性银行立法纳入立法规划,并着力构建科学的政策性银行立法体系,立法应合理贯彻政策性银行的政策性,兼顾规定性与灵活性,兼顾现实性和前瞻性,我们还应“量身定做”,打造科学的政策性银行监管制度。

As of now, we haven＇t enacted any special laws or administrativ of policy banks are just found sporadically in some lower-ranked regulations. The bar,ks legislation are as follows： low steps of law making and disorder in system, e regulations, the rules main problems of policy vacancy and lagging of important rules, absence of specialized supervision rules, etc. The implementing of the Eleventh Fiveyear Plan makes it more possible to perfect the legislation of policy banks, in that taking legislative measures is the demand of the Plan to carry out the reformation of policy banks, the implementing of the whole Plan provides a practising environment and inspecting standards, and that the fundamental condition is provided. During the future five years, we should enroll the policy banks regulation into legislation plan, and try to set up a rational regulation legislation system. When we make the specific regulations, we should carry through the policy-related principle moderately, make the rules comprehensive and flexible, practical and prospective, as well as try to make some specialized supervision rules.
