记名提单的性质与放货

通过对Document of Title的涵义的分析,指出记名提单就其性质而言,是货物占有与授权凭证,记名提单与海运单的本质区别也在于此,论述了记名提单作为Document of Title应当凭单交货。

Through the analysis of the meaning of Document of Title, this paper points out that as far as the nature of a straight bill of lading is concerned, it is a document of title that proves by whom the goods are possessed or controlled and that the possessor of the same document has been authorized to transfer or receive goods represented thereby. The essential difference between seaway bill and straight one consists just in this point. This paper also discourses upon that as a Document of Title, a straight bill of lading shall be produced before cargo released.
