刑法规定的受贿罪基本构成要件中,“为他人谋取利益”的认定标准不断提高,相关解释仍然存在模糊之处,导致适用上的诸多困难,而刑法的补救效用甚微。这一构成要件的存在,本身就是反腐败防线过于靠后的标志,应予取消,以抑制“关系”对公共权力的严重腐蚀。

Among general constitutive elements of the crime of acceptance of bribes in the criminal law, ＂securing benefit for the person＂ has difficulties in application because of more and more strict condition and illegible interpretation, which resulted in feeble effect of criminal remedy. This constitutive element, whose existence indicates the back line of defence of anti - corruption. should be abolished to control the ＂relationshitp＂ severelv corrupting the public Dower.
