构建我国犯罪被害补偿制度之设想

Construct A Compensation System for the Erroneous Judgment

从经济上弥补犯罪被害人的损失是平复被害人的最有效的途径,许多国家都通过制定犯罪被害补偿制度来实现对被害人的权利保障。我国目前没有关于被害人国家补偿的制度规定,本文提出了建立我国犯罪被害补偿的具体构想,以期推动我国犯罪被害补偿制度的构建。

The economic compensation for the erroneous judgment is the most effective approach to pacify the victims. Now many countries have constructed the compensation law for the victims to achieve the insurance of the victim＇s rights. However, there are not any systematic rules, related to the national compensation for the victims in China. This paper puts forward the concrete concent of the compensation law to aim at improve its formation.
