Thoughts on Law-methodology about the Theories of the Real Right Behavior

物权行为是物权法理论的瓶颈,自其产生之日起围绕它的论战便经久不息,或支持或反对,理论上攻守激烈。本文通过对物权行为理论进行宏观性、整体性的思考,试从法学方法论的角度,探讨物权行为理论在法律形式理性主义分析、审视下的意义。

The real right behavior is the bottleneck of the real right theories. Since it came out, the quarrel about it on theory is lasting, either support or objection,and the quarrel is fiercing theoretically. Through thinking the real right behavior theory from macro and whole view, the paper tries to study the significance of real right behavior theories on the form of law under rationalism from the angle of the law methodology.
