盐业合伙契约作为我国近现代一种独具民族传统特色的资本组织形式,具有十分丰富的内容和非常鲜明的特点。本文通过对盐业合伙契约内容和特点的分析,探讨我国现行合伙法律制度反映出的调整范围过窄、合伙组织形式单一等滞后于现实经济社会发展且亟待解决的问题,并提出完善现行合伙法律制度的建议。

Partnership is a type of organizing form of corporations divided by ways of investment and forms of debt undertaken, and it has a history of over a thousand years. As an organizing form of capital with national and traditional characteristics today, the partnership contract of the salt industry has very abundant content and vivid characteristics. Observing the content and characteristics of the partnership from the angle of law, the paper discusses the law system of current China＇ s partnership and reflects some important problems that is urgent to solve, such as over narrow adjusting range, singleness of organizing system, etc.
