摘要
美国医疗不当案件中的惩罚性赔偿制度已经有二百多年的历史了,在美国的法律制度和法律实践中,这一制度具有重要的功能。为了应对批评者的意见并逐步完善医疗不当案件中的惩罚性赔偿制度,这一制度的改革就是必不可少的,并出现了许多具有重要参考价值的改革建议。
The institution of punitive damages in American medical malpractice cases has been in existence for more than 200 years and has been playing an important role in both theory and practice. In order to respond to the critics and gradually perfect this institution, it is necessary to reform it, for which many valuable suggestions have been presented.
