公共设施致害的案例在实践中并不少见,国家赔偿法没有对此的相关规定,实践中也是按照民事赔偿来处理的,混淆了法律关系,存在严重弊端,公共设施致害应当纳入国家赔偿范围。

In practice, there are many legal cases of the damage caused by the public facilities, and state compensation dont have relevant stipulation to this kind of case. We usually deal with it according to civil compensation in practice. Thus law relation is confused and grievous malpractices are existed. So the damage caused by the public facilities should be classified into the scope of state compensation.
