应赋予公民法律解释的动议权——由成都人大的地方法规受到的启示

Citizens Should be Give the Right of Suggestion to Law Explanation——An inspiration from the local regulation of Sichuan people's resentative committee

公民法律解释的动议权是公民的一项宪法性权利,赋予公民此项权利有利于扩大公民民主参与性,有利于为公民权利提供另一种新的救济手段,也有利于法律的进一步完善。但现行法律中缺乏对该权利的具体规定,应在《立法法》及相关的法律中明确赋予公民法律解释的动议权,并建立健全公民启动法律解释的程序规则。

The right of suggestion to law explanation is a right endowed by constitution to the citizens. It is advantageous to extend the citizens democratical participation, to provid another redress means for the citizen fight, and to further perfect the law. But there aren＇t concrete provisions about the right in the current law. It should give the right of suggestion to law explanation definitely in the lawmaking law and related law, and build up the procedure rule that the citizens apply the fight.
