本文从证明的一般层面上探讨了证明涵义、分类、特征、作用四个最基本的理论问题。从不同层次上将证明、法律证明、诉讼证明区别开来,揭示了证明与诉讼证明的内在关系,阐明了诉讼证明在证明体系中的地位与作用。
The paper, from the general meaning of evidence, explores the four fundamental theoretical problems of evidence, such as its connotation, classification, characteristics and role, from different layers, differentiates evidence from legal evidence and lawsuit evidence, discloses the inner relationship between evidence and lawsuit evidence, and explains the position and the role of lawsuit in the evidence system.
