循环经济是建立节约型社会,实现中国经济可持续发展的重要途径。法制建设是发展循环经济的制度保障。但现有的循环经济法制还不健全,基本的框架还没有完全建立起来,在一定程度上制约了我国循环经济的发展。要大力发展循环经济,必须要加强循环经济立法,建立循环经济的法律体系。在立法中,应遵循以国家统一立法,制定指导性原则；地方配合立法,落实具体措施的路径。
