略论法律逻辑学的研究视角

On Research Perspectives of Law Logic

法律逻辑学研究的发展,需要思考和厘清包括其研究视角等在内的一系列基本理论问题。确立法律逻辑学的研究视角应考虑两个要素：一是这种研究应有助于揭示和刻画法律人的思维特征及方式,并为其提供有效的思维工具和逻辑方法。二是能够为有关人类思维活动的研究开辟新领地,有助于更完整地认识人类思维的多样性和复杂性,从而推进逻辑学的研究。在此基础上提出了法律逻辑学多维研究视角中的3个方向：第一,研究人类共通的思维形式及规则在法律人思维中发生的各种变形；第二,研究人类共通的思维形式及规则在法律人思维中的应用条件；第三,对法律概念和法律规范进行逻辑或语言的分析。

A series of basic problems like research perspectives must be thought through clearly before the development of law logic research. Two factors are to be considered in the establishment of research perspective of law logic： （1） the research will be helpful for revealing and depicting the features and ways of the law-man＇s thinking, and provide him effective thinking tools and logic methods; （2） the research will help to open a new field for the research of human＇s mental activities and to have a thorough understanding of the variety and complexity of human＇s thinking so as to boost the logic development. Three directions of multiple research perspectives of law logic are proposed here： （1） studying the various transformations of the common thinking forms and rules of human beings in law-man＇ thinking; （2） studying the applying condition of the common thinking forms and rules of human beings in law-man＇ thinking; （3） conducting the logic and language analysis on law concepts and law criterion.
