Construction of a fair and justice, socialist and harmonious society, has become the current important ruling idea of the Communist Party of China and the social development target. The paper tries to explore the contradictions among theories of fairness and justice in the recent western society by combining those comparatively important theories, and points out that basic institution environments of China have provided possibilities for solving these contradictions and realizing the comprehensive, balanced, scientific theory of fairness and justice by taking Chinese reality into full account. Meanwhile, The paper provides operational reasoning about location and allocation of our government＇s public functions under the current circumstances in the theoretical view： ruling rights protection of law, equalizing public service, and rationalizing redistribution.
