人民主权与政府公权力的委托—代理关系决定了现代政府必须是责任政府,但这种政府观及政府设置的层级控制体制有产生主客二元的分离对立可能。一是人民主权的价值理性与政府公权力的工具理性的背离,政府权力没有体现其对外的“公仆的责任”;二是政府各权力主体在保持公权力的均衡和自我净化方面背离其内部责任。
