On the Perfection of Market-Regulated Law in the Control of Ecological Cost

构建和谐社会必须控制生态成本,生态成本的有效控制途径之一是完善市场规制法。包括:细化“消法”规定的安全保障权和知情权以实现消费者环境权益;制定包括“环境指标”在内的新的产品质量标准,加强对产品环境质量的认证工作;健全产品的环境标志法律制度,普遍消费环境友好型产品;建立绿色包装制度,减轻生态环境负担;健全完善竞争垄断法,增加“反不利于生态成本控制的不正当竞争和垄断行为”规定。

The construetion of harmonious society requires the control of ecological cost and one of the effective ways is to perfect the market regulated law. The market- regulated, a branch of economic law oriented in social interest, can perfect the realization of the control of ecological cost. First, the safety fight and right to know must be detailed to safeguard consumer＇s environmental right. Second, new product standards must be developed so as to reflect the environmental denotation and to better the certification of the environmental quality of product. Third, the labeling system must be perfected to guide consumers to choose environment - friendly products. Fourth, green package system must be developed to alleviate the ecological burden. Finally, non- justifiable and monopoly action unbeneficial to the control of ecological cost must be regulated.
