党的十六大把“社会更加和谐”作为全面建设小康社会的目标之一提了出来,一个灵活、广泛、有效、快捷的纠纷解决机制是构建和谐社会对纠纷解决机制提出的新要求。法院调解制度作为我国多元化的纠纷解决体系的一元有着重要的价值和功能。但是,目前这一制度已不能满足21世纪中国现实社会的需要,现实迫使我们对法院调解制度进行反思和重构。

At present the court mediation system cannot meet the needs of Chinese society in the 21st century, which forces us to reflect on and reconstruct the court mediation system.
