解析法理学方法构建

The Construction of Jurisprudence Method

虽法学史册众说纷纭,然法理学与自然科学的交叉确已是大势所趋。这样的交叉必然导致在传统法理学中引入自然科学的解析方法。传统法理学几乎纯粹在社会科学领域,而解析方法的构建目的是使法理学回到自然。解析法理学方法能够完美解决传统法理学根本无力解决的两大基本问题:中国文化承载法治问题和法治统一问题。

Although in the legal scientific history, books there are many theories, the jurisprudence and the natural sciences overlapping already were necessary. Such overlapping necessity causes in the jurisprudence to introduce the analysis method of the natural sciences. Jurisprudence nearly purely is in social science domain, but the goal of constructing the analytic method is to enable the jurisprudence to return to the nature. The analysis jurisprudence method can perfectly solre the two major basic problems which traditional jurisprudence basic cannot solve the question of Chinese culture influencing law and unification.
