摘要
消极诉讼观在当代中国农民中是非常普遍的。它既有传统诉讼文化的制约,又由农村社会现实状况决定,还受司法制度的缺陷影响。它的存在,妨碍农民自身权利的维护,损害司法权威,阻碍法律至上精神的形成。因此,必须通过开展普法教育、推进司法制度改革、挖掘传统诉讼文化的合理内核等途径,实现农民诉讼意识由消极诉讼观向健诉诉讼观的现代性转变。
Passive litigation conception is very common within the contemporary Chinese peasant. It is caused by some reasons including the tradition litigation culture, the realistic status in the rural, the judiciary＇ s drawback. It harms the peasant＇ s rights and the judiciary＇ s authority. It also hampers the development of the sainted law＇ s spirit. So, we must develop the law popularization, retbrm the judiciary, excavate reasonable litigation character so as to achieve the transformation from passive litigation to healthy litigation.
