摘要
刑法本身不应是暴虐与残忍的代名词。相反,刑法本身应为和谐而存在。刑法的和谐包括刑法的外部和谐与刑法的内部和谐。刑法的和谐统摄着诸如正义等刑法价值。刑法的和谐在本质上是利益关系的和谐。
Criminal law should not be regarded as brutality and erueliy, On the contrary, criminal law exits for harmoniousness. Harmoniousness of criminal law governs justice and other values of criminal law. Harmoniousness of Criminal law is in essence harmoniousness of relationship of interests.
