摘要
中国的劳动力市场基本上是完全竞争市场,劳动力产权已得到较好的界定,但是,劳动契约制度的发展却没能和产权同步进行,以至劳动力市场仍是一个残缺的市场。本文将从制度变迁的角度去分析劳动关系及劳动契约的演变,并将此问题纳入到契约分析的框架中,以说明劳动契约的签订和实施中存在的不足,为劳动契约的创新提供一些有益的启示。
The labor market of China is in perfect competition on the whole, in which the property right of labor is properly defined. However, it is still an unsound market because the labor contract system isn't developing in synchronism with the property right. The paper analyses the evolution of labor relationships and labor contracts from an angle of system transition, and illuminates the weaknesses in the signing and implementing of labor contract by engaging the evolution in the framework of contract analysis in order to give some beneficial enlightenment to the innovation of labor contracts.
