业主支付担保制度的试行效果及发展前景分析——基于对深圳、厦门工程担保制度的试点调查 被引量:9

The Effects and Perspective of Owner's Payment Bonding System in China——Based on Survey in Shenzhen and Xiamen

摘要 基于作者对深圳、厦门推行工程担保制度试点情况的调查,着重对强制性业主支付担保制度的试行效果进行了分析研究。结果显示,尽管两地业主支付担保的试点情况并不理想,但我国“建设者留置权”缺位的现实环境下,业主支付担保制度不仅有存在的必要,而且有必要将政府监管机构列入保函名义受益人而加以强化,从而形成对承包商工程款支付的有效救济。另外,业主支付担保在公共工程中未来的发展前景则需要结合具体的公共工程建设组织模式来确定。 Based on a survey for the pilot system of construction bonding in Shenzhen City & Xiamen City, the feature and effects of Owner's Payment Bonding practices are concluded and analyzed. It's found that the application of Owner's Payment Bonding System is not really successful; nevertheless, as the absence of Mechanics' Lien, for private works, it is still necessary to promote the application and even to enhance the coerciveness of this system by adding the construction administration authority as one of the beneficiaries, by which the Owner's Payment Bond evolves from a contract bond to a non-contract permit & license bond, becomes a effective rescue for the contractors to get their payment. For public works, the perspective of the Owner's Payment Bonding System may be varied due to different project organization models.
