摘要
行政诉讼受案范围是行政诉讼理论与实务研究的重要问题。我国行政诉讼法有关受案范围的确立模式、抽象行政行为、内部行政行为及行政终局行为的可诉性等问题都有待进一步完善。我国行政诉讼受案范围立法应取消肯定列举式的规定,而采用由肯定的概括、否定的列举及例外三个部分结合构成的立法模式;规章及规章以下的规范性文件等抽象行政行为以及涉及公务员基本权利的内部行政行为都应纳入行政诉讼的受案范围;我国有必要取消行政最终裁决,以扩大行政诉讼受案范围。
The scope of accepting administrative cases is an important question both in administrative lawsuit theory and practice. For our country, such questions as the mode of defining the scope of accepting administrative eases, whether abstract administrative action, internal administrative action and the resulting administrative action can be sued or not need further improvement. On legislation, the mode of listing the scope of accepting administrative cases should be canceled and the mode of formative summary, negative listing and exception should be used. Such actions as abstract administrative action made according to and below rules and regulations, internal administrative actions related with the basic rights of official servants should be concluded in the scope of administrative lawsuits. It ' s necessary for our country to cancel the final judge of administrative department and enlarge the scope of accepting administrative cases.
