在立法表达中,存在许多用来联结法律规范各组成部分的虚词,如“可以”、“必须”、“不得”、“应当”等,这其中“应当”是用的最多的。然而,这些在立法中使用频率颇高的虚词,却没有得到法学界应有的重视,其结果就是立法表达中出现了一些相关的混乱。因此,应当重视对“应当”等虚词的研究。

There are many empty words in the work of legislation, such as may, must, should, ought to. In general, the empty word should, or the phrase ought to, is used the most in legislation. However, all these empty words have not arouse enough attention although they are used so frquently and confusedly. So, it is necessary to study these empty words, especially the should, the first step of which is to analyse the meaning of these words.
