摘要
分析了我国奥林匹克标志法律保护的依据,发现我国奥林匹克标志法律保护还存在一些问题,主要表现在:立法方面存在缺陷;行政执法认定不准,缺乏配合;司法保护审理期限过长,效率不高;法律法规体系未能同国际条约、国际惯例完全接轨等。提出了完善我国奥林匹克标志法律保护的对策。
By using method of documentary and logical analysis, this article analyzed the legal basis of Olympics symbols protection in our country, and discovered some problems as the follows in the process of legal protection. There is deficiency in the legislation; the administrative law lacks accurate recognition and cooperation; the judicial protection costs excessive judgment time ; and the legal laws and regulations system have not been able to meet international treaties and convention as well. It also proposed countermeasures to perfect legal laws.
