消费者在与经营者进行交易时,两者都享有公平交易的权利,基于消费者的弱者地位,法律给予消费者特殊保护。但在现实生活中同时也存在着消费者权利的不正当行使现象。正确解读消费者权益保护法的内容,正当行使权利,发生纠纷通过正当途径解决,才能切实保护消费者的合法权益和社会公共利益,促进商业文明和精神文明以及和谐社会的建设。

Both the consumer and the proprietor have a fare right in transactions. Owing to the relatively weak position the consumer possess, the law favors the consumer in some aspects. However, in daily life, the consumer＇ s right is always exercised wrongly. So only when the Consumer Protection Law is interpreted properly, the consum- er＇ s right is exercised justly and the dispute is settled by right means will the consumer＇ s legitimate rights ＆ interests and the social common interests be protected, and construction of the business civilization, the spirit civilization and harmonious society be promoted.
