高校学生管理法制化是实施依法治国的重要环节。笔者认为,传统观念中的人治观念、义务本位观念、息诉观念、教育观念等影响着学生管理法制的完善;高校与学生的法律地位不明确,导致学生管理的规章制度中学生的权利、义务界定不清;高校自主权作为一种权力在行使的过程中,法律责任不明、缺乏必要的监督;高校在教育市场上的强势地位,使得学生管理的法律、法规没有得到很好的贯彻和执行。
