摘要
我国现行的人民陪审制仍属于参审制的模式。参审制最大的误区,就在于让非专业法官解决法律专业性问题,因此违背了诉讼的规律,在很多方面存在致命的缺陷。要让人民陪审制在中国真正发挥弘扬司法民主、促进司法公正、保证司法廉洁的功能,还有很长一段路要走。
Existing people jury system in China is still part of the mode of the system of participative jury, the largest wrong region of which lies in：non-professional judges solve professional questions, which violates the litigation law,there are defaults in many aspects.People jury system in China has a long way to go in justice democracy, open in justice, honest function of justice, etc.
