试论我国沉默权制度建立的障碍和对策

On the Obstacle and Countermeasures of the Establishment of China's Silent Power System

沉默权已成为世界各国普遍承认的一项基本诉讼权利。我国现有的制度和传统的司法观念对于沉默权的建立有一定的障碍。我们必须从观念上、制度上和立法上进行改革,以利于我国沉默权制度的建立,适应国际人权制度发展的需要。

Silent power has become a fundamental litigation right accepted by all the countries in the world. China＇ s existing systems and traditional judicial views have a certain obstacle to the establishment of China＇ s silent power system, so we must make a reform in views, systems, and legislations, in order to help the establishment of China＇s silent power system, fit in with the needs of the international human right system.
