公平作为法律价值观的重要内容,它主要反应社会利益的一种协调和平衡状况。公平首先不是作为一个具体的绝对恒定的价值体系出现和存在的,相反,公平有着不同的时代内涵。从表现形式上来说,公平价值观大致可以分为结果公平、机会公平和制度公平。在当下中国社会,这集中体现为“效率优先,兼顾公平”的价值观念。在当今时代,这种法律合法性的以经济为指向的价值观已经显露出诸多弊端,为此,必须与时俱进地发展公平的时代内涵,将和谐发展为现代公平法律价值观的核心内涵。

As an important content of the value of law, Equity mainly responds of a kind of condition with coordination and equilibrium among social benefits. Equity firstly does not appear or exist as an absolute, concrete and eternal system of worth . Contrarily; the equity has a different ages content. As the form of manifestation is concerned, the value of equity can be mostly divided into three fortes： result equity, opportunity equity and institution equity. At the moment of China society, it concentrates on the concept of value of ＂efficiency first, equity considered＂. Now, this kind of value that oriented with economy with which to justify law has already emerged many abuses, AS a result, we must develop the value of law with ages and take harmony as the core content of the equity value of law.
