摘要
通过语境化的阅读,本文从海瑞的论述中抽象出有关司法的两个定理:公平定理和差别定理。文章在理论层面和社会历史层面逐一论证其合理性和正当性,力求展示其隐含的,基于主观边际效用的,强有力的经济学逻辑。论文还将其中可能最有争议的差别定理进一步一般化,逐步延伸到刑事司法——支持疑罪从无(轻)原则,和民事法律的领域——提出有关“人格物”的概念,力求充分展示其具有的理论力量。
On the basis of contextualized reading, the author abstracts two judicial laws from Hai Rui's statements: that of equity and that of discrimination. By revealing and elaborating the rationale behind these laws from a theoretical and socio-historical perspective, the article seeks to demonstrate an implicit yet convincing economic logic based on subjective marginal utility. It further extends the more controversial law of discrimination to the domain of criminal justice to support the doctrine of the presumption of innocence, and to the domain of civil justice to propose the concept of the “personified object,” so as to demonstrate its theoretical strengths.
