《物权法》(草案)与农民工权益保障有关问题分析

Protection of Peasant-workers' Rights and Interests in the Law of Property(Draft)

我国《物权法》(草案)中的土地承包经营权、宅基地使用权和居住权,对保障农民工权益具有重要的意义。《物权法》(草案)虽然还没有直接将农民工纳入调整范畴,但由于农民工仍然属于农民的一种,当然享有农民应该享有的各种物权,我国物权法应该将农民工作为物权法的法律主体,直接纳入调整范围。

The right to contracted management of land, the right to the use of homestead, and the right of dwelling specified in the Law of Property （Draft） are crucial to the protection of peasant-workers＇ rights and interests. Though peasant-workers are not covered in the Law of Property （Draft）, they are entitled to all kinds of real rights of peasants as they are one part of peasants. It＇ s proposed in this paper that peasant-workers should be the subject of legal relationship and covered in the Law of Property.
