Discussion on Safety Production Supervision of Project Construction

《建设工程安全生产管理条例》将监理单位定为承担施工生产安全责任的主体单位之一,对此行业内有不同的争议.从法理、国际惯例上进行分析,认为要求监理单位承担施工生产安全责任依据不充分.但从当前国内施工生产安全的严峻形势来看,监理单位进行施工生产安全监理,并承担部分施工生产安全责任是必要的.建议在《建筑法》修订时应妥善处理此问题.

Administrative Regulations on Safety in Construction Projects defines supervision companies as one of the main units of assuming construction production safety responsibilities. There are some different opinions about this in the building trade. This paper considers that the evidences about supervision companies assuming construction production safety responsibility are not plentitude from discussing in the nomology and the international traditions. However, in the austerity position of construction production safety in the domestic, it is necessary that supervision companies actualize construction production safety supervision and assume a part of construction production safety responsibility. It is suggested that this problem should be dealt with in the emending of the Construction Law.
