摘要
从法律文化的角度出发,比较分析了法律文化对中西商业及商法发展的不同影响,从商主体的法律地位、商业法律的形成以及封建经济对商业发展的影响等方面揭示了商业及商法发展与法律文化的相互关系。
The author takes a comparative analysis of the different influences of the legal culture on the commerce and the commercial law development in eastern and western eotmtries, and it is from the perspective of legal culture. The reciprocity between the commerce as well as the commercial, eial law development and the legal culture is revealed respectively from the legal status of business body, the formation of commercial law, and the feudal economic impact on commercial development, etc.
