ANALYSIS OF THE ILLEGAL LAND CASES IN INNER MONGOLIA

内蒙古土地违法案件现状分析表明:违法案件数量呈下降趋势;违法用地规模呈上升趋势;非法占用土地案件居各类违法之首;经济发展快的地区土地违法案件发生率高。原因是土地管理法律法规宣传不到位,农民及基层干部法律意识淡薄;土地执法监察保障条件差,理论研究薄弱;盲目追求经济利益,短期行为严重等。针对这种现状,应采取加强土地管理全过程执法,注重发挥其整体功能;规范土地执法程序,从严查处内部违法行为等对策和措施。

An analysis of the illegal land cases in Inner Mongolia these years shows that the number of illegal land cases is dropping while the scale of illegal land use is rising, the rate of illegal land cases is high in areas where economy is developing rapidly and cases of illegally occupied land come first among all kinds of illegal cases. Reasons are as follows： first, propaganda of land management laws and regulations is not in place and the law consciousness of peasants and cadres at the basic is weak ; second, guarantee for the supervision of land enforcement is poor and theoretical research is insufficient ; third, the pursuit of economic profit is blind and the short-term behavior of land use is serious, etc. Considering the situation, it is necessary to strengthen the enforcement of the entire process of land management, to emphasize the overall function of land management and to formulate law enforcement process and to investigate and treat illegal behaviors strictly.
