Comparative Law in Modern China

比较法是近代西方法律文化的产物,自19世纪中期以来开始在中国传播。汉字的比较法(比较法学)一词是20世纪初年从日本传入中国的。一批著名的学者和论著对中国的比较法学科的形成和发展作出了重要的贡献。由于受到国内立法政策和研究环境等因素的影响,因此近代中国的比较法也具有自己的鲜明的特征。

The comparative law is a product of modern western legal culture, and started to spread in China since the middle of 19th century. The concept of “science of comparative law” in Chinese character was introduced into China from Japan in early 20th century. Then many famous scholars and works made critical devotion to the formation and development of Chinese comparative law science. Due to the influence.of domestic legislative policy and the background of the research, the modern Chinese comparative law science has presented distinct characteristic of itself.
