先秦时期债流转的史实补析

The Analysis of Historical Facts of the Obligation Transferring in the Time Before Qing Dynasty

考古发现和传世文献表明,商周至战国时期,债权债务关系随社会经济的发展而发达,解决债权债务纠纷的案例增多,实践中出现了不自觉的债的分类调整,对债的不同表现形式也有对比研究,体现出中国先秦时期调整债的法文化特征。

As shown in the recordings of archaeological discoveries and histoncal documents,from Snang, Zhou to Warring States Period, there had been more and more obligation relationships arising with the development of social economy. With the increase of cases settling credits and debts, the classification of types of obligation naturally appeared in the practice, while different forms of obligation were made comparison to each other, all of which set the legal cultural for the adjustment of the obligation before Qing Dynasty in China.
