异议登记的制度建构——法律移植的微观分析

异议登记在登记错误时能阻断登记公信力,保全真实权利。我国物权法在移植域外法的异议登记时,应从功能主义比较法的基本立场出发,选择和考察适当的移植对象,确立最有效的移植范本,进行本土化的改造。这种法律移植的方法和步骤可以作为一般性规则适用于私法规范的移植。

When the land registration has any error, to protect the true right, the dissent registration can turn the right in the land registration to be nothing in the field of Property Law. To replant the dissent registration from foreign law, Chinese Property Law should adopt the functionalism method of comparative law; namely, the replanted object should be elected and investigated properly, the system model should be the most effective, and the reform to make the rule meet the indigenous situations and meets should be necessary. Moreover, as a kind of common rule, the above transplant method can be applied to all kinds of transplants in the private law.
