浅议提高我国诉讼法律移植的效用

On Promoting the Effectiveness of China's Drawing on Procedural Law

守旧的观念使得在移植国外的诉讼法律时未能吸收先进的诉讼法律理论和诉讼法律精神,而在本土化的过程中,又受到了传统法律意识的阻碍。为了提高我国诉讼法律移植的效用,一方面,在移植的过程中,要从中国实际出发,注重所移植法律的适度超前;另一方面,在内化的过程中,要营造有利的实施环境。

Conservative concepts prevent people from adopting the advanced theory and essence of procedural law when drawing on other countries＇ procedural law whereas people＇s traditional awareness of law hindered its localization. Therefore, to promote the effectiveness of our drawing on procedural law of other countries, it is essential to proceed from China＇s actual situation and lay stress on appropriate foresight of the procedural law that is to be adopted on the one hand, and to create favorable environment for practice in its intemalization on the other hand.
